미 이민국(USCIS) 미국투자이민 관련 안내 사항

미 이민국(USCIS)는 EB-5 투자이민 “개정” 규정들과 관련된 새 예상일자들 (2018년 8월과 2019년 3월)을 발표하였습니다.
 
EB-5 미국투자이민 법 개정 시점에 관한 내용을 포함하는 미국 예산관리국 (Office of Management and Budget)의 2018년 봄 통일의제 (Unified Agenda)의 내용입니다.

 
1. 최소 투자금액과 TEA (고용촉진지역) 지정방식의 변화

투자금액 인상과 TEA 지정방식의 변화에 대한 최종조치 (Final Action) 예정일자는 이제 2018년 8월로 예상되고 있습니다 (RIN 1615-AC07, “EB-5 이민 투자 프로그램의 현대화 (Immigrant Investor Program Modernization)”). 예상대로8월에 마무리될 경우, 개정된 이민규정들은 빠르면 금년 (2018년) 9월부터 효력을 발할 것으로 보입니다. 이민국은 최소투자금액을 TEA지역의 경우, $103.5만불로, 비TEA지역의 경우엔 $180만불로 인상할 것을 제안해놓은 상태입니다. 또한 우선순위일자 (priority date)의 보전에 대한 부분 (I-526청원서를 승인받은 투자자가 기존 우선순위일자를 유지하면서 새로운 I-526청원서를 접수할 수 있도록 하는 방안 등)도 개정안에 포함되어 있습니다.
 
이러한 구제방안은 특히 중국인 투자자들에게 굉장히 중요한 사안입니다.

 
2. 리저널 센터 지정 및 사전승인 (Exemplar Approval) 절차

리저널 센터 지정과 사전승인 절차의 변화에 대한 개정규정 작성 예정일자는 이제 2019년 3월로 예상됩니다 (RIN 1615-AC11, “EB-5 이민 투자 프로그램의 현대화 (Immigrant Investor Program Modernization)”).

USCIS Publishes New Estimated Dates (August 2018 & March 2019) for Publication of EB-5 “Reform” Regulations.
 
“The Office of Management and Budget (OMB) Spring 2018 Unified Agenda has been published, with new estimated dates on action for EB-5 regulations.
 
 Minimum Investment Amount and TEA Changes
The estimated Final Action for changes in the proposed investment amount and TEA changes is now August 2018 for RIN 1615-AC07 (EB-5 Immigrant Investor Program Modernization). If Finalized in August, the regulations could be effective as early as September 2018. USCIS had proposed increasing the investment amount to a minimum of $1,035,000 for TEA and $1.800,000 for non-TEA. Also included in the draft was some priority date protection (an investor with an approved I-526 could choose to file a new I-526 while keeping the original priority date, subject to certain restrictions).
 
This relief is very important for Chinese investors.
 
 Regional Center Designation and Exemplar Approval Process
The estimated Notice of Proposed Rule-making for changes in the regional center designation and the exemplar approval process is now March 2019 for RIN 1615-AC11 (EB-5 Immigrant Investor Regional Center Program)
