위의 표에서 EB-5 를 살펴보면, 직접투자 카테고리는 현재 승인이 되고 있는 반면

간접투자의 경우는 창구가 닫혀 있어 승인이 나고 있지 않다는 것을 확인 할 수 있습니다.

아래는 미 이민국에서 EB-5 간접투자의 대한 답변 입니다.

Pursuant to the continuing resolution signed on November 21, 2019,

the immigrant investor pilot program is extended until December 20, 2019.

The I5 and R5 visas may be issued until close of business on December 20, 2019, and may be issued for the full validity period.

No I5 or R5 visas may be issued overseas, or final action taken on adjustment of status cases, after December 20, 2019.

The final action dates for the I5 and R5 categories have been listed as “Unavailable” for January.

If there is legislative action extending the categories for FY 2020,

the final action dates would immediately become “Current” for January for all countries except China-mainland born I5 and R5,

which would be subject to a November 22, 2014 final action date;

India I5 and R5, which would be subject to a May 1, 2018 final action date;

and Vietnam I5 and R5, which would be subject to a December 8, 2016 final action date.     

위 미 이민국에서 명시한 내용을 확인하자면,

2019년 12월 20일 이전까지는 EB-5 간접투자에 대한 이민비자를 발급하고 있으나

12월 20일 이후부터 EB-5 비자 발급이 안된다고 명시하고 있습니다.

그렇기 때문에 1월 영주권 문호에서는 미승인으로 표기 되고 있습니다.

이어서 회계연도 2020년의 예산안이 확정된다면,

미승인이었던 창구가 중국을 제외하고는 오픈으로 바로 바뀔것이라고 합니다.

미국 현지에서는 정부의 셧다운을 막기위하여,

현지시각 12월 19일 미 하원에서 승인된 예산안이 상원에서 승인되었고,

지난 12월 23일 트럼프 대통령이 예산안에 최종 승인 하였습니다.

이에따라, 큰 이슈가 없는 한 2월 영주권 문호에서는 ‘오픈(Current)’ 될 것이라 예상됩니다.
